NYC Inspector Lied About Asbestos for Ten Years

Let's add a new area of fraud for New York injury lawyers. And let's call this one "asbestos fraud".

Perhaps that's slightly a misnomer and I may be stretching the concept a little too thin. But a New York safety inspector has been caught red-handed, so to say.

Saverio F. Todaro, 68, as admitted that he lied about his inspections for a period of over a decade. During that time, he was a licensed safety inspector and was required to make critical assessment of asbestos and lead content in buildings throughout the city of New York.

Todaro filed reports, often saying that he found no danger. He filed hundreds of these reports.

But despite the fact that he filed hundreds of reports purporting to perform safety tests at various buildings throughout New York and at various New York construction sites, Saverio Todaro actually performed no tests.

That's right. He allegedly never even performed one test.

Although the current case is a criminal case against Saverio Todaro, the issue presents New York injury lawyers with questions relating to tort liability stemming from a criminal act.

In order for New York personal injury attorneys to hold Todaro liable, under tort doctrine, they would have to show that an injury occurred as a result of detrimental reliance on the false statements made by Todaro. And given that his false statements are documented, a potential avenue for liability could arise if an individual suffered mesothelioma or any other illness as a result of the chemicals in the buildings.

As Saverio Todaro's criminal case unfolds, New York personal injury lawyers will be watching closely.
