They're the forgotten heroes of 9/11. And over the weekend, one of them passed away.
On Saturday, Police Officer Robert Oswain passed away. He was just 42 years old. Robert Oswain was an officer from the Bronx and had been serving in the recovery efforts at Ground Zero in the aftermath of the September 11th attacks on the World Trade Center.
Oswain died of cancer.
It is believed that the toxic dust at Ground Zero caused Robert Oswain's cancer.
New York injury lawyers have been fighting against the lawyers for the city in a battle to hold the city and various contractors liable for the injuries sustained at the WTC site in the days following 9/11. The rescue workers toiled away at the site of the now defunct World Trade Center, sifting through asbestos-laden dust, pulverized concrete, glass fibers and various other toxic debris, according to Courthouse News. The complaint filed in Manhattan court argued that the workers were not provided adequate protection from the debris, among other complaints.
A settlement was reached earlier this year between the city of New York and the New York injury lawyers representing the plaintiffs in the action. The settlement, however, bore many implementational complications and was rejected by Judge Alvin Hellerstein of the Federal District Court.
The settlement was, in itself, a work of legal art. Not necessarily good art, but a work of art, nevertheless. New York personal injury lawyers had somehow managed to get a settlement that structured the damages into a tier system, paying out for injuries ranging from the fear of getting sick to compensating families for the loss of loved ones lost in the rescue efforts.
