Lindsay Lohan has been blasted in the answer to her complaint filed against E*Trade.
The E*Trade baby has spoken, again!
I wrote a few posts on Lindsay Lohan. Why, you ask, would I write about Lindsay Lohan for a New York personal injury law blog? Why on earth would New York personal injury lawyers care about Lindsay Lohan?
Well, in case you don't remember, Lindsay Lohan filed a defamation lawsuit against E*Trade.
Lindsay Lohan believed that the "milkaholic" baby Lindsay featured in the company's Superbowl ad was a reference to her. She argued that she had first-name recognition status, like Oprah or Bono.
And she argued that the E*Trade ad defamed her.
I already posted an article showing the E*Trade baby defend itself. But now, E*Trade has finally emerged in their legal defense against Lindsay Lohan. And their New York personal injury lawyers are asking: How much can you defame someone who's already done a good job of defaming themselves?
E*Trade made an effort to show that Lohan had defamed herself by attaching online comments about her.
Some of the comments are cited as saying: "How can she pay her rent and pay for her coke?"
Other commenters call her a "pot-stirring, lazy, irresponsible, disrespectful little drama queen."
And to top it off, the E*Trade lawyers filed hundreds of pages with the court, showing Lindsay Lohan's drug problems, brawls and DWI arrests.
A defense that New York personal injury attorneys can raise in a defamation lawsuit is the defense of truth. So I suppose that's what E*Trade's lawyers are doing.
By showing how defamed Lindsay Lohan really is, can they really help their case?
Lindsay Lohan's mother, Dina Lohan, doesn't think so. She claims that these court papers are only going to help Lindsay Lohan's case.
