George Harrison's former doctor is being sued.
But not by the estate of the Beatle's legend.
This time, Dr. Gilbert Lederman's New York personal injury lawyers are defending him in a case of wrongful death stemming from alleged malpractice.
Dr. Gilbert Lederman is said to have treated Giuseppa Bono, the 34 year old mother of three, who died in 2003. At the time she met with Dr. Gilbert Lederman, she claimed she had been diagnosed with pancreatic cancer by doctors in Italy.
As a result of this supposed diagnosis, Giuseppa Bono met with Dr. Lederman and Dr. Philip Silverman in 2002. She received radiation treatments from both doctors and then returned to Sicily.
Guiseppa Bono died shortly thereafter.
Her diagnosis of pancreatic cancer had never been confirmed in the United States, nor in Italy. In fact, some are saying that she may have been suffering from inflammation of the pancreas, rather than the cancer that she had originally claimed.
The big question for his New York injury lawyers will rest on his duty owed to the patient. His New York personal injury lawyers will also have to ask questions relating to industry norms and standards. Essentially, if the doctors deviated from standard industry practices, then they may be found liable of medical malpractice.
As it stands, the New York injury lawyers for the doctors are claiming that in some cases, pancreatic cancer cannot be proven by biopsy.
But does this fact really alleviate and remove the obligation for these doctors to perform a biopsy? What do other doctors do, when confronted with a similar situation?
Interestingly, Dr. Gilbert Lederman is no stranger to the courts. He was sued by the estate of George Harrison when the doctor was accused of forcing the Beatle's star to autograph a guitar on his deathbed.
