Drop side cribs may soon be history.
After allegedly causing numerous infant deaths and being responsible for several cases of strangulation and suffocation, the Consumer Product Safety Commission said that it plans to enact mandatory safety regulations, banning the sale and manufacture of drop-side baby cribs.
Drop-side baby cribs look like standard cribs but feature one side that slides down or can even be removed. In the last ten years, there have been over 32 cases of reported deaths as a result of drop-side cribs.
The main problem with these cribs is the fact that the drop-side can push away from the crib, exposing a gap in the crib that can be deadly for infants.
While many of these cribs are no longer sold in stores, some are still available for sale on Craigslist. And although it might sound like a good bargain to buy one of these cribs and repair it by oneself, New York personal injury lawyers are warning against the legal risks of fixing the cribs.
At this stage, New York personal injury lawyers would warn parents that it's simply wiser to avoid these cribs. Assuming an injury were to happen from a crib that had been fixed independently, it would be a lose-lose scenario for the plaintiff. Essentially, once you've taken it upon yourself to fix a crib, it becomes that much harder for a New York personal injury attorney to prove that the injury was the result of a flaw in the crib's original manufacturing.
While the legislative ban has yet to take effect, parents are being urged to contact the CPSC or the crib manufacturer for further details and instructions.
